The Process of Obtaining an Uncontested Divorce in Virginia with Attorney Mark Loria

1. Preparation and Filing of the Complaint

2. Service of Process

a. Acceptance of Service and Waiver of Notice by Defendant (Must be executed after Complaint filed). Allows proceeding to Final Hearing immediately.

b. Order of Publication (Legal Notice in Newspaper for 4 consecutive weeks, then wait 21 days to proceed to Final Hearing). Transcripts of the Final Hearing are required for all cases where service is accomplished by publication.

c. By Process Server (Waiting period 21 days after Service to proceed to Final Hearing)

3. Deposition or ore tenus hearing (Final Hearing). All Publication cases require the filing of deposition transcripts, therefore the Final Hearing for all Publication cases is done by way of deposition.

4. Submission of Final Decree and Deposition transcripts (if applicable) for Entry of Final Order by a Judge of the Circuit Court. VS4 Form must be filed as well.

5. Await Entry of Final Decree by the Court. Certified copy of Final Decree obtained by attorney after Final Decree is entered by the Court and provided to client.
